These Terms of Service (“Terms”) are an agreement between you and C10Sync LLC (“C10Sync,” “we,” “us”). They govern your use of c10sync.com and the C10Sync software (the “Service”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent (“you” or the “Shop”). If you do not agree, do not use the Service.
The Service
C10Sync provides software for auto repair shops and mobile mechanics, including estimates, invoices, digital vehicle inspections, scheduling, dispatch, customer messaging, and tools for taking payments. Features vary by plan. We may improve, change, or retire features over time.
Accounts
- You must be at least 18 and authorized to bind the business you sign up for.
- Give accurate information and keep it current. Keep your password secret. You are responsible for activity under your account, including your staff’s.
- Tell us promptly if you think your account has been accessed without permission.
Free trial, plans, and billing
- New accounts may start with a free trial. We do not require a card to start a trial.
- Paid plans are billed monthly in advance at the price shown when you subscribe. Subscription payments are processed by Stripe.
- Your plan renews each month until you cancel. You can change plans or cancel at any time in Settings, then Billing. A cancellation takes effect at the end of the billing period you have paid for.
- Plan fees are not refunded for partial months, except where the law requires. We will tell you before a price change takes effect, and you can cancel before it applies.
- You are responsible for any taxes that apply to your use of the Service.
Taking payments from your customers
C10Sync lets you take card payments from your own customers through payment providers such as Stripe and Square. C10Sync is not a bank and does not hold your customers’ money. Payments go to the payment account you connect, and that provider’s terms apply to it, including the Stripe Connected Account Agreement for Stripe.
You are responsible for your prices, taxes, refunds, chargebacks, disputes, and your own compliance with card-network rules and consumer-protection laws. Processing fees charged by your payment provider are separate from your C10Sync plan fee.
Your data and your customers’ data
You own the data you put into the Service, including information about your customers and their vehicles. You give us permission to host, process, and display it to provide the Service to you, as described in our Privacy Policy. You are responsible for having the right to enter that data and for telling your customers how you use it.
You can ask us for a copy of your data. After you close your account, we will keep it for a reasonable period so you can retrieve it, then delete or de-identify it unless the law requires us to keep it.
Text messages and email
The Service can send text messages and emails to your customers on your behalf. You must have the permission the law requires before contacting a customer, and you must honor opt-outs, including replies of STOP. You are responsible for the content of the messages you send and for following laws such as the Telephone Consumer Protection Act and the CAN-SPAM Act.
AI features
AI features, such as labor estimating, produce suggestions based on what you enter and may be wrong or incomplete. Check every estimate against manufacturer information and your own judgment before you give it to a customer. You are responsible for the repairs you recommend and the prices you charge.
Acceptable use
You agree not to:
- break the law, or use the Service for fraud or to harm others;
- send spam or messages to people who have not agreed to receive them;
- try to break, probe, or overload the Service, or get around its security or limits;
- access another Shop’s data, or resell or sublicense the Service without our written permission;
- upload content that is unlawful, infringing, or harmful, including malware.
We may suspend an account that breaks these rules or puts the Service or others at risk.
Third-party services
The Service connects to third-party services such as Stripe, Square, QuickBooks, PartsTech, and Worldpac. They are governed by their own terms, and we are not responsible for them. Connecting one is your choice.
Our property
The Service, including its software, design, and trademarks, belongs to C10Sync LLC or its licensors. We give you a limited, revocable, non-transferable right to use the Service during your subscription. Feedback you give us may be used without obligation to you.
Availability and support
We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. Maintenance, outages, and events outside our control can affect it. Support is available by email and phone as listed on our support page.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not provide legal, tax, accounting, or repair advice.
Limit of liability
To the fullest extent the law allows, C10Sync will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim arose. Some places do not allow these limits, so they may not fully apply to you.
Indemnity
You will defend and reimburse us for claims, losses, and costs (including reasonable attorneys’ fees) that arise from your content, your customers’ data you put in the Service, your messages to your customers, your repairs or services, or your violation of these Terms or the law.
Ending these Terms
You can stop using the Service and cancel at any time. We may suspend or end your access if you break these Terms, do not pay, or if we must for legal reasons. Sections that by their nature should continue after the agreement ends, such as data ownership, disclaimers, limits of liability, and indemnity, will continue.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Texas, and you and we agree to their jurisdiction.
Changes to these Terms
We may update these Terms. If a change is material, we will tell account holders in the Service or by email before it takes effect. Using the Service after the change means you accept it.
